PART I — 한국어 이용약관 (대한민국 사용자)

제1장 총칙

제1조 (목적)

이 약관은 Stellara(이하 "회사")가 제공하는 Stellara 서비스(이하 "서비스")의 이용에 관한 조건 및 절차, 회사와 이용자의 권리·의무 및 책임 사항을 규정함을 목적으로 합니다.

제2조 (정의)

1. "서비스" 란 회사가 운영하는 Stellara 음악 탐험 플랫폼 및 관련 부가 서비스를 의미합니다.
2. "이용자" 란 이 약관에 동의하고 서비스를 이용하는 모든 자를 의미합니다.
3. "회원" 이란 Google 계정을 통해 서비스에 가입하여 이용자 아이디(ID)를 부여받은 자를 의미합니다.
4. "갤럭시(Galaxy)" 란 회원의 음악 우주를 표현하는 개인 공간 단위를 의미합니다.
5. "행성(Planet)" 이란 갤럭시 내에 생성되는 음악 콘텐츠 단위를 의미합니다.
6. "공명(Resonance)" 이란 다른 회원의 행성을 자신의 갤럭시에 저장하는 기능을 의미합니다.
7. "유료 플랜(Plus)" 이란 회사가 유료로 제공하는 부가 서비스를 의미합니다.

제3조 (약관의 게시 및 개정)

1. 회사는 이 약관을 서비스 초기 화면 또는 연결 화면에 게시합니다.
2. 회사는 「약관의 규제에 관한 법률」, 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 등 관련 법령을 위반하지 않는 범위에서 약관을 개정할 수 있습니다.
3. 약관을 개정할 경우, 적용일 및 개정 사유를 명시하여 현행 약관과 함께 서비스 화면에 그 적용일 7일 이전부터 적용일까지 공지합니다. 단, 이용자에게 불리한 내용의 변경인 경우 30일 이전부터 공지합니다.
4. 이용자가 변경된 약관에 동의하지 않는 경우, 서비스 이용을 중단하고 탈퇴할 수 있습니다. 약관 변경 이후 서비스를 계속 이용하면 변경된 약관에 동의한 것으로 봅니다.

제4조 (약관의 해석)

이 약관에 명시되지 않은 사항은 「전기통신사업법」, 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」, 「전자상거래 등에서의 소비자보호에 관한 법률」 및 관련 법령 또는 상관례에 따릅니다.

제2장 이용 계약 체결

제5조 (이용 계약의 성립)

1. 이용 계약은 이용자가 약관의 내용에 동의한 후 서비스 이용 신청을 하고, 회사가 이를 승낙함으로써 성립합니다.
2. 서비스는 Google OAuth를 통한 소셜 로그인 방식으로만 가입할 수 있습니다. 회사는 별도의 비밀번호를 관리하지 않습니다.
3. 만 14세 미만의 이용자는 법정대리인의 동의 없이 서비스를 이용할 수 없습니다.

제6조 (이용 신청의 승낙 및 제한)

회사는 다음 각 호에 해당하는 경우 이용 신청을 승낙하지 않거나 사후에 이용 계약을 해지할 수 있습니다:

1. 타인의 정보를 도용하거나 허위 정보를 기재한 경우
2. 만 14세 미만인 자가 법정대리인의 동의 없이 신청한 경우
3. 서비스 운영을 방해하거나 방해할 우려가 있는 경우
4. 관련 법령에 위반된 목적으로 신청한 경우
5. 기타 회사가 합리적인 판단에 의해 필요하다고 인정하는 경우

제3장 서비스의 이용

제7조 (서비스의 제공 및 변경)

1. 회사는 다음 서비스를 제공합니다:

• 3D 우주 기반 음악 탐험 인터페이스
• 갤럭시 및 행성 생성·관리 기능
• 타 회원 갤럭시 워프(방문) 기능
• 공명(Resonance) 기능
• YouTube 재생목록 임포트 기능 (연결 동의 시)
• 유료 Plus 플랜 서비스

1. 서비스는 연중무휴 24시간 제공을 원칙으로 합니다. 단, 시스템 점검, 장애 등의 사유가 발생할 경우 일시적으로 서비스가 중단될 수 있으며, 이 경우 사전 공지합니다 (긴급 사유 발생 시 사후 공지 가능).

1. 회사는 서비스의 품질 향상을 위해 서비스 내용을 변경할 수 있으며, 이 경우 변경 내용과 적용일을 공지합니다.

제8조 (서비스 이용 제한)

1. 저작권 준수: 이용자는 타인의 저작권, 지식재산권을 침해하는 콘텐츠를 업로드하거나 공유해서는 안 됩니다.
2. YouTube 이용약관 준수: YouTube API를 통해 제공되는 기능 이용 시 YouTube 서비스 약관(youtube.com/t/terms)을 준수해야 합니다.
3. 불법 행위 금지: 법령에 위반되는 방법으로 서비스를 이용해서는 안 됩니다.

제9조 (이용자의 의무)

이용자는 다음 행위를 해서는 안 됩니다:

1. 회사 또는 제3자의 지식재산권, 초상권, 명예를 침해하는 행위
2. 서비스를 해킹하거나 악성 코드를 유포하는 행위
3. 타 이용자의 계정에 무단으로 접근하는 행위
4. 서비스를 통해 스팸, 광고성 콘텐츠를 무단으로 전파하는 행위
5. 자동화 도구(봇 등)를 이용하여 비정상적인 방법으로 서비스를 이용하는 행위
6. 서비스의 정상적인 운영을 방해하는 행위
7. 음란물, 폭력적 콘텐츠 등 법령에 위반되거나 미풍양속에 반하는 콘텐츠를 등록하는 행위
8. 만 14세 미만의 아동에 관한 개인정보를 수집하거나 유포하는 행위

제4장 콘텐츠 및 지식재산권

제10조 (이용자 콘텐츠)

1. 이용자가 서비스에 등록한 콘텐츠(갤럭시 이름, 소개글, 행성 이름, 설명 등)에 대한 저작권은 이용자에게 귀속됩니다.
2. 이용자는 회사에게 서비스 제공 목적으로 해당 콘텐츠를 이용, 복제, 수정, 전시할 수 있는 전 세계적, 비독점적, 무상의 라이선스를 부여합니다. 이 라이선스는 서비스 운영과 개선 목적으로만 사용됩니다.
3. 이용자가 서비스에서 탈퇴하거나 콘텐츠를 삭제하면 해당 라이선스는 종료됩니다. 단, 법령에 따른 보관 의무가 있는 경우 또는 다른 이용자가 공명한 콘텐츠의 처리 기간은 예외로 합니다.

제11조 (회사의 지식재산권)

서비스와 관련된 소프트웨어, 디자인, 상표, 로고 등의 지식재산권은 회사에 귀속됩니다. 이용자는 회사의 명시적 동의 없이 이를 복제, 수정, 배포할 수 없습니다.

제12조 (YouTube 콘텐츠)

서비스를 통해 재생되는 YouTube 콘텐츠의 저작권은 각 콘텐츠 제작자 또는 YouTube에 귀속됩니다. Stellara는 해당 콘텐츠를 직접 스트리밍하거나 저장하지 않으며, YouTube API를 통해 연결하는 방식으로만 제공합니다.

제5장 유료 서비스

제13조 (유료 플랜)

1. 회사는 무료(Free) 플랜과 유료(Plus) 플랜을 제공합니다.

1. 유료 플랜 요금 및 결제 방법은 서비스 내 결제 페이지에 게시합니다.
2. 유료 서비스 이용 요금은 결제 시점에 즉시 부과됩니다.

제14조 (결제 및 환불)

1. 유료 플랜은 제3자 결제 대행사를 통해 결제됩니다.
2. 청약 철회:

• 「전자상거래 등에서의 소비자보호에 관한 법률」 제17조에 따라 결제 후 7일 이내에 청약 철회를 요청할 수 있습니다.
• 단, 이미 서비스를 상당 부분 이용한 경우 청약 철회가 제한될 수 있으며, 이 경우 이용한 부분에 해당하는 금액을 공제하고 환불합니다.

1. 회사의 귀책 사유로 인한 서비스 장애의 경우, 실제 서비스 불가 기간에 대해 비례 환불합니다.
2. 환불 요청: axion.1215@gmail.com 또는 서비스 내 고객 지원

제15조 (구독 서비스)

1. Plus 플랜이 구독(정기 결제) 방식으로 제공되는 경우, 이용자가 직접 취소하지 않으면 자동 갱신됩니다.
2. 구독 취소는 갱신일 24시간 전까지 서비스 내에서 가능합니다.
3. 취소 후에도 해당 결제 기간의 말일까지 서비스를 이용할 수 있습니다.

제6장 계약 해지 및 이용 제한

제16조 (이용자의 계약 해지)

1. 이용자는 언제든지 서비스 내 계정 탈퇴 기능을 통해 이용 계약을 해지할 수 있습니다.
2. 계약 해지 시 관련 법령에 의해 보관이 필요한 정보를 제외하고, 이용자의 모든 개인정보 및 콘텐츠는 즉시 삭제됩니다.
3. 탈퇴 전 진행 중인 유료 결제가 있는 경우, 해지 처리 전에 이를 확인하시기 바랍니다.

제17조 (회사의 이용 제한 및 계약 해지)

1. 회사는 이용자가 이 약관을 위반하거나 다음 각 호에 해당하는 경우 사전 통지 후 서비스 이용을 제한하거나 계약을 해지할 수 있습니다:

• 타인의 저작권 침해 행위
• 서비스 운영 방해 행위
• 불법 콘텐츠 등록
• 기타 법령 위반 행위

1. 긴급한 경우(서비스 보호, 법령 위반 등)에는 사전 통지 없이 즉시 제한 조치를 취할 수 있습니다.

제7장 책임 제한 및 분쟁

제18조 (회사의 면책)

1. 회사는 천재지변, 전쟁, 테러, 해킹 등 불가항력적 사유로 인한 서비스 장애에 대해 책임을 지지 않습니다.
2. 회사는 이용자의 귀책 사유로 인한 서비스 이용 장애에 대해 책임을 지지 않습니다.
3. YouTube 콘텐츠: 회사는 YouTube API를 통해 제공되는 콘텐츠의 가용성, 정확성, 적법성에 대해 보증하지 않습니다. YouTube 서비스 변경, 콘텐츠 삭제, API 정책 변경 등으로 인한 불편에 대해 책임을 지지 않습니다.
4. 이용자가 서비스를 통해 제3자와 발생한 분쟁은 당사자 간에 해결해야 하며, 회사는 이에 대해 책임을 지지 않습니다.
5. 무료 서비스의 경우, 관련 법령이 허용하는 최대 범위 내에서 회사의 손해배상 책임을 면제합니다.

제19조 (손해배상)

1. 회사의 고의 또는 중과실로 이용자에게 손해가 발생한 경우, 회사는 관련 법령에 따라 손해를 배상합니다.
2. 유료 서비스의 경우, 회사의 귀책 사유로 인한 손해배상 책임은 해당 이용자가 최근 3개월간 납부한 이용 요금을 한도로 합니다 (법령에서 별도 정하는 경우 제외).

제20조 (준거법 및 관할)

1. 이 약관은 대한민국 법률을 준거법으로 합니다.
2. 서비스 이용에 관한 분쟁은 대한민국 법원을 관할 법원으로 합니다.
3. 단, 한국 외 거주 이용자에 대해서는 제21조 (영문 약관 제14절)의 국제 분쟁 해결 조항이 적용될 수 있습니다.

PART II — English Terms of Service (Global Users)

*This Part II applies to users outside the Republic of Korea. For Korean users, Part I (Korean) controls.*

Section 1. Agreement to Terms

By accessing or using Stellara ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Service Description: Stellara is an immersive 3D music discovery platform. It does not directly stream music but provides an interface layer to explore music through YouTube and user-curated "galaxies" and "planets." Stellara is not a music streaming service.

Section 2. Eligibility

• You must be at least 13 years old (or the minimum age in your jurisdiction, whichever is higher) to use the Service.
• Users in the EU/EEA must be at least 16 years old (or the minimum digital consent age in their member state) for data processing based on consent.
• You represent that all information you provide is accurate and complete.

Section 3. Account Registration

• Accounts are created exclusively via Google OAuth. We do not store passwords.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access to your account.
• You may not create accounts for others without their permission.

Section 4. Service License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

Section 5. User Content

Your Content: You retain all ownership rights to content you create on Stellara (galaxy names, descriptions, planet names, etc.).

License to Us: By posting content on Stellara, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and adapt that content solely for the purpose of providing and improving the Service. This license ends when you delete the content or close your account.

Your Responsibility: You are solely responsible for the content you post. You represent that:

• You own or have the right to share the content
• Your content does not violate any third party's rights
• Your content complies with all applicable laws

Section 6. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe intellectual property rights of others
• Upload malicious code or attempt to hack the Service
• Use automated tools to access the Service in a way that burdens our infrastructure
• Harass, abuse, or harm other users
• Upload content that is unlawful, harmful, threatening, or obscene
• Circumvent any access control or security measures
• Use the Service for any commercial purpose without our written consent

Section 7. YouTube API Services

Stellara uses YouTube API Services. By using YouTube-related features, you also agree to:

• YouTube Terms of Service: https://www.youtube.com/t/terms
• Google Privacy Policy: https://policies.google.com/privacy

Your YouTube access token is stored only in your browser's session storage and is never transmitted to our servers beyond what is necessary to complete API requests. Disconnecting YouTube from your account settings immediately revokes this access.

Section 8. Paid Plans (Plus)

8.1 Plan Features

8.2 Payment

• All payments are processed by a third-party payment processor.
• Prices are displayed in the Service before purchase.
• All fees are exclusive of taxes unless stated otherwise.

8.3 Subscriptions

• If Plus is offered as a subscription, it will automatically renew unless cancelled.
• Cancel at least 24 hours before the renewal date via account settings.
• Upon cancellation, you retain Plus access through the end of the paid period.

8.4 Refunds

• EU/EEA users: You have a 14-day right of withdrawal from the date of purchase under EU Consumer Rights Directive, unless the service has been fully performed with your prior consent.
• UK users: You have a 14-day cancellation right under the Consumer Contracts Regulations.
• US users: Refunds are handled on a case-by-case basis. Contact us at axion.1215@gmail.com.
• Australian users: Refunds are provided in accordance with the Australian Consumer Law.
• Other users: Refund requests are evaluated in accordance with applicable local consumer protection laws.

Section 9. Account Termination

9.1 Your Right to Terminate

You may delete your account at any time through the Service's account settings. All your personal data and content will be deleted immediately, except where retention is required by law.

9.2 Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in illegal activity
• Abuse the Service or other users

We will generally provide notice before termination unless the violation is severe or we are legally prohibited from doing so.

Section 10. Disclaimers

"AS IS" BASIS: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

YouTube Content: We do not control, endorse, or guarantee the availability, accuracy, or legality of any content accessed via YouTube API. Changes to YouTube's service, content removal, or API policy changes are beyond our control.

Service Availability: We do not guarantee uninterrupted, error-free service. Scheduled maintenance and unexpected outages may occur.

Section 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM.

Exceptions: Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

Consumer Rights: If you are a consumer in the EU, UK, or Australia, these limitations apply only to the extent permitted by applicable consumer protection laws.

Section 12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of any third party's rights

Section 13. Intellectual Property

The Service, including its design, software, trademarks, and logos, is owned by Stellara and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written consent.

Section 14. Governing Law and Dispute Resolution

For users in the EU/EEA:

These Terms are governed by the laws of the Republic of Korea, but mandatory consumer protection laws of your country of residence also apply. Disputes may be referred to the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

For users in the United Kingdom:

These Terms are governed by the laws of the Republic of Korea, but you retain any rights under UK consumer protection laws.

For users in the United States:

These Terms are governed by the laws of the Republic of Korea. BINDING ARBITRATION: Any dispute shall be resolved through binding arbitration under the rules of [Arbitration Institution], except:

• Either party may seek injunctive or other equitable relief in court
• Claims that qualify for small claims court

CLASS ACTION WAIVER: You waive any right to bring or participate in a class action or class-wide arbitration.

For all other users:

These Terms are governed by the laws of the Republic of Korea. Disputes not resolved through good-faith negotiation shall be submitted to the courts of the Republic of Korea.

Section 15. Changes to Terms

We may update these Terms from time to time. We will notify you:

• At least 7 days before changes take effect for minor changes
• At least 30 days before changes take effect for material changes (changes that affect your rights)

Continued use after the effective date constitutes acceptance of the revised Terms.

Section 16. General Provisions

• Severability: If any provision is found unenforceable, the remaining provisions continue in force.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.
• Waiver: Failure to enforce any provision does not waive our right to enforce it later.
• Assignment: You may not assign these Terms. We may assign them without restriction.
• Language: In case of conflict between language versions, the Korean version controls for Korean users; the English version controls for all others.
